BestWeb's Terms of Service

You may:

You have purchased the right to dial into BestWeb's service on an unlimited, interactive basis (unless you have an hourly or other account that is not unlimited). This means you may use the service as much as you want as long as you are actually in front of your computer and using it. This means that if you are not going to be using the Internet for more than 10 minutes or so, you should disconnect. You specifically have not purchased the right to run a process on your computer that leaves you connected all the time or that automatically reconnects you when you are not present. We also reserve the right to disconnect you if we determine that you are not actually present and using the Internet

You must accept individual responsibility for your account. We expect that you will adhere to reasonable security standards and not share your password, leave your password lying around in plain text, or otherwise compromise the security of your account. Your account is for a single user only, and there are very few reasons anyone would need to give out his or her password. If you must share your password with a consultant, then you should change it back to a secure password as soon as the consultant is finished. Feel free to E-mail support for help with changing your password. Understand that unless we have reason to believe your account was broken into by means completely out of your control, we have to hold you responsible for policy violations stemming from your account.

Any illegal use of your account, connection, or server space may result in immediate disconnection of your service pending investigation. We will fully cooperate with any law enforcement authorities and are not responsible for any monetary or other losses resulting from such disconnection.

BestWeb is not responsible for any costs you incur to access the service or as a result of your accessing the service. These costs include, but are not limited to, telephone charges, costs relating to your computer, items purchased through the Internet, or any physical or mental anguish caused by Internet usage or lack thereof.

BestWeb's maximum liability for problems with your service is a prorated credit or refund for time that your service was interrupted due to something under our control. BestWeb makes no express or implied warranties of service in connection with use of Internet access. You agree that BestWeb is not liable for any loss of service, loss or damage to data or damage to equipment or software or any other loss, damage or inconvenience resulting from reliance on or use of Internet access.

Use of your account constitutes agreement to pay BestWeb in accordance with the schedule of fees. Payment is due IN ADVANCE each month. If your account is billed to your credit card, you agree that BestWeb can charge your card for service each month. In the event of cancellation, you will not receive a refund for any unused time on your account, but you will not be charged for further services.

 
You may not:

Your account with BestWeb is subject to the following rules. Failure to abide by these rules may result in the immediate termination of your account without refund.

You may not do anything illegal or anything that adversely affects BestWeb's legal interests. We recognize that not all users are well versed in the vagaries of local, state, federal, and international law. While some infractions may be due to ignorance on the part of the user, ignorance is not an excuse for breaking the law. An accidental first offense may be cause for leniency on our part - this will be at the discretion of BestWeb staff. Please consult an attorney if you are unsure of the legal status of your activities.

You may not share your password with anyone nor allow anyone else to use your personal account except in your immediate presence, nor dial in more than once at the same time on your personal account.

You may not tamper with other accounts, or commit unauthorized intrusion into any part of BestWeb's system or use any of BestWeb's machines, files or accounts to intrude without authorization into any other system (cracking).

You may not use BestWeb services not included in your subscription or devise ways to circumvent security so you have access to services you haven't paid for (theft of services).

You may not use the system (willfully or negligently) in a manner that encumbers disk space, processors or other system resources so as to interfere with others' normal use of services on BestWeb or on other systems (a "denial of services" attack).

You may not harass users (on BestWeb or elsewhere). Sending E-mail or real-time messages to a user who has asked explicitly and unambiguously that you not do this is harassment. In some cases, a harassing user may be warned against engaging in similar behavior with other users as well. Publishing someone's real-world data (phone number, address, social security number, etc.) in a news group or on the web, etc. in such a way as to cause the person trouble or to incite others to do so (even if you don't do it yourself) is also forbidden. (Establishing that the information you published is available, say, in a phone book somewhere does not constitute a defense of this kind of harassment.)

You may not abuse the services of a remote server, or violate a remote system's terms of service while connected to that service from your BestWeb account.

You may not send unsolicited mass mailings (spam) or unsolicited subscriptions with a "negative option" for continuation. (The negative option is one where you invite people who do not wish to receive further mailings to reply to you.)

You may not run daemons, MUDs, BOTs, or other background processes. Run a server from your non-dedicated SLIP/PPP dial-up Run programs such as "keepalive" or any other program intended to circumvent the idle-timeout.

BestWeb takes no responsibility and has no liability whatsoever for any information, including images, sounds, or other data that you may send to or receive from the Internet. You agree to take total responsibility for both your usage and that of any other people who gain access to the Internet through your account.

The following rules pertain specifically to usenet postings (news groups). If you never use usenet, they don't apply to you. You may not spam the net with commercial or noncommercial postings, maliciously or wantonly flood newsgroups, post usenet articles without either a valid from or reply-to header, or post binaries to a non-binary usenet newsgroup.

If you have a web site on our web server, it is NOT acceptable to spam the 'net with ads for your URL. If we are informed of your so doing, we will inform the postmasters at the site of origin of the spam, assuming it's done from a remote site. If the problem continues, we may revoke your BestWeb account or server hosting privileges because of it. We do not in any way condone spam of any kind, and we will not accept as customers users who abuse the Internet in this way.

You may not store any objectionable material on any BestWeb server. Objectionable material includes, but is not limited to pornographic images. BestWeb reserves the right to delete any material from BestWeb servers that we deem to be objectionable.

Also, we reserve the right to terminate your account without refund for other kinds of nontrivial misbehavior, although in our entire history we have never terminated an account for reasons other than those listed here. In all of these matters, decisions by BestWeb staff are final.

We reserve the right to amend these rules without prior notice. Changes will be announced via E-mail and on our web page. If you have any questions
